Article 101 of the Treaty on the Functioning of the European Union (TFEU) is a cornerstone of European competition law. It prohibits anti-competitive agreements and practices, such as cartels, price-fixing, and market sharing. The economic effects of Article 101 have been extensively studied, but empirical evidence on its enforcement and effectiveness is scarce.

This book presents an empirical study of Article 101 TFEU. The study uses a unique dataset of all Article 101 cases decided by the European Commission and the European courts between 1990 and 2016. The dataset includes information on the type of infringement, the size of the firms involved, the duration of the investigation, and the outcome of the case.

Key Findings

The study finds that Article 101 has been effective in deterring anti-competitive behavior. The number of Article 101 cases has declined over time, and the average fine imposed by the Commission has increased. The study also finds that Article 101 has been more effective in deterring cartels than other types of anti-competitive behavior.

However, the study also finds that Article 101 enforcement is not perfect. The Commission is more likely to investigate and sanction large firms than small firms. The study also finds that the Commission is more likely to sanction firms that have a dominant position in the market.

Policy Implications

The study's findings have important implications for competition policy. The study suggests that the Commission should continue to focus on deterring cartels and other serious anti-competitive behavior. The study also suggests that the Commission should make greater efforts to investigate and sanction small firms and firms that do not have a dominant position in the market.

This book provides a comprehensive empirical analysis of Article 101 TFEU. The study's findings have important implications for competition policy and provide valuable insights into the dynamics of competition law and economics.
